Long story, josh, but I thought you were cullman (Doorman) and I was playing totally off for any one else. I literally have been waiting hours to play this dude. Suddenly I realize he's not there and I'm freaking out. Had to leave when I got ahead.

Lol. In the past day I have dropped from 306 to 224. Doorman has beat me the last three games we played (and apparently the last two against Nate too). This game is rough.

I started off by offering to play him, since he said he was going to try to explore the game on a Tuesday morning. He seemed too busy for that and eventually just sent me like 4 questions to answer. Pretty basic stuff except for asking me if I thought this whole thing was "an experiment" and if the game required skill to which I responded to the effect of "not after the first $500" and "absolutely."

I'm definitely a secondary character here, but thought just maybe....

Interesting anecdote: I felt very guilty after the first $500 I won from Doorman and at that point explained as best as I could what he was doing wrong. It was much, much harder to get the next $400. And I imagine orders of magnitude harder than when you started. smile

I feel a little silly though thinking the whole week that I was going to be in the story. Oh well.

Honestly AnoHito, I get what you're saying and I don't have a very good response. That setup certainly seems like something that would be ruled illegal, but perhaps it's because you've explicitly stated that you've tied it to a chance event.

Another approach to this that I just encountered: can you lose at the game?

In the absence for now of any scientific proof, Prof. Nesson urged the group to come up with more legalistic arguments. Ms. Duke has won more than $3 million in tournament prize money. One sure sign that poker is a skill, she says, is that unlike roulette or the lottery or betting on football, "you can purposely lose at poker if you choose." To lose requires skill, she says -- or at least an ability to affect the outcome.

Between human players, you could certainly lose intentionally given enough RPS games. Just play rock every time. We all agree you can lose CM on purpose too, right? That's not really enough to meet a legal requirement, but it's an interesting perspective.

I think the crux of it here is that the game isn't "subject to chance" just because someone could theoretically base their actions on chance. Subject to chance means elements of the game that aren't controlled by the players have nondeterministic outcomes.

The term ‘game of chance’ has an accepted meaning established by numerous adjudications. Although different language is used in some of the cases in defining the term, the definitions are substantially the same.  It is the character of the game rather than a particular player's skill or lack of it that determines whether the game is one of chance or skill.

In a game like Cordial Minuet where random play can be effective, though not necessarily more effective than deliberate play, it may actually cause legal issues.

cullman's chess analogy is pretty useful here. Likewise, a totally random CM column picker is very easy to beat on average. A random RPS player cannot be beat on average.

Also, this testimony is pretty convincing:

To me the test is this, when I was first starting out I won ZERO games against a good player, that to me says that it is a game of skill.  In fact, in my first 20 games I don't think I even won a round of the game - surely if luck was a big factor I would have won one even by accident.  As a beginning poker player I won many sit and go tournaments just purely based on the strength of my cards.

Sure. First, I'm going under the assumption that certain board variations are inherently advantageous (the whole point of this thread).

If that's the case, then the person that gets the advantageous rotation has an advantage. They'll also get to see the 90 degree rotation, but only if they stick around for it. Instead they could use the advantageous rotation to their advantage by using it to maximize their profit or simply force a fold and then leave.

The solution is to set aside the first and second round antes ahead of time. That way if you get the disadvantageous rotation, you can simply fold. The other player is obligated to either play out the second round or sacrifice the second round ante if they leave in the first OR second round.

Now, no one can claim they got the bad luck of the rotation order favoring their opponent. With this in place, I don't see any hint of randomness at all.

I agree with you that I wouldn't notice if not told. I actually came close to posting that sentiment, but can't say 100%. There are certain details I pay attention to that might clue me off. Anyway, I'll never know now.

That "boring" response was just a gut reaction. If your goal is to make the legal case as tight as possible, I think you should go for it.

I still think the optimal design would be taking both antes up front. That well and truly removes any hint of randomness for good.

Very nice, Nate! If you do the math, that's like the rake from 10s of thousands of dollars trading hands.

That makes me wonder about economics of CM as a product. To provide a decent annual return, people would collectively have to be gambling millions of dollars per year.

It's probably irrational, but I really don't like that as a thing. Seems boring.

It doesn't completely eliminate the randomness either. If you get the optimal rotation on turn one, you've either got a better chance to beat your opponent or they know it's optimal and they just fold. You can leave that game right after the first round... unless somehow both antes are already set aside.

Is this mainly driven by the legal concern or what?

Also, before I even played Judge, I would often lure people into a 5 dollar game after throwing a couple 1 dollar games.

AnoHito (I'll stop call you that smile), you're saying a lot of true things definitely. Conservative play is favored. Correct play usually involves a lot of folding. Bluffing on the first round is indeed easily exploitable .... as you can see on the leaderboards.

I certainly don't like the idea of super short games, but you might be right that everyone is happy if it's a configurable option.

The big question is: will new players really understand the significance of the chip count? Do they currently understand the implications of the chip count? I'm not even sure I do. If the UI gets chip counts added to it (next to stakes presumably), I bet that's going to be at least a little confusing. And it also goes back to your claim that new players are actually leaving because of the chip count issue? I'm skeptical on that one. Regardless, that's an empirical claim that Jason could investigate (i.e. are droves of players withdrawing their moneys?).

[Off topic but something that is bugging me a lot. A game is what occurs before one player leaves. A round is what culminates in a fold or final scores. A ______ consists of one bet and up to one column pick. What word should I be using because round is confusing me.]

Same here. I've never been into gambling before. I've played $20 on a slot machine and poker among friends once or twice. I never really "got" poker, but Cordial Minuet really makes me want to get into it.

I concur, this sounds great. There's probably more worst case scenarios one could dream up, but at some point you just need to test it out.
